It's no coincidence that most of the companies who have developed this kind of specialized software are based in California, where we own the dubious distinction of having introduced structured monthly pesticide use reporting in 1990. The good news, of course, is that we now have a very comprehensive statewide database of accurate multi-year application data, which is much more useful than hypothetical estimates or unsubstantiated (and often exaggerated) claims. One of ChemTrak's setup features is a table which lists all 50 states. The program user "tags" each state in which they apply pesticides, and ChemTrak will reconfigure data entry screens as necessary to prompt for those states' required information, and redefine the 'Reports' menu to list the reports that may be required in those states. If any specific requirements are added for a given state, our policy is to incorporate them into the program promptly upon notification, at no charge. States which we're aware have special *reporting* requirements include California, Washington, Arizona, Texas, and Michigan (plus perhaps a few others I can't think of right now). Others (such as Ohio) may not have a formal reporting program but still require that additional data be kept with application records. Wells, Director of the California Department of Pesticide Regulation, signed (adopted) the regulation action that will make the changes in California regulations to formally implement the WPS. This is a major step in the proccess which pretty well "fixes in stone" what the new regulations will be. There are still some procedural steps including, the California Environmental Protection Agency, the State Department of Finance (due to cost impacts on State agencies), and final review by the Office of Administrative Law ( the overall regulation watchdog agency). There is also the need for a final blessing by the U.S. EPA. It is not expected that any of these pending reviews will result in any sinificant text changes. A January 1, 1997 effective date is still anticipated. A "clean" version of the new regulations will be sent to county agricultural commissioners by the Enforcement Branch in the near future. I received a call from an Agway dealer in Maine greatly concerned that he was not able to sell some WPS stickered inventory. Last year, he contacted the EPA/registrant hotline and received some "STOP" stickers for his older agricultural products. He has since obtained product-specific supplemental labeling for each product. Monday in the mail he recieved a notice; from whom, he does not know, because his secretary threw out the envelop. It reads: AGCHEM DEALERS: CONFUSED ABOUT WPS STICKERS? It goes not to state: "Products with STICKERS LIKE THESE CANNOT BE SOLD AFTER OCTOBER 23, 1996. Contact the manufacturer's sales representative for further assistance. These all start with "STOP! Use this product only..." My dealer is confused because he believe that what he received from the hotline would be sufficient, now only to find out he should have been doing something else and maybe can't sell this? The WPS required labeling changes for many end-use pesticide products. The Agency issued several PR Notices to provide guidance to pesticide registrants on amending product labeling to comply with WPS labeling requirements. A description of these notices follows: 1) In April 1993, EPA issued PR Notice 93-7, which provided guidance for registrants on amending WPS product labeling. 2) In August 1993, EPA issued PR Notice 93-11, which provided several options for registrants to meet the WPS-specified deadlines for incorporating WPS labeling onto products. 3) In September 1995, EPA issued PR Notice 95-5. It provided guidance for retailers and distributors of agricultural pesticides for relabeling non-WPS-complying products, through use of stickering and product-specific WPS supplemental labeling and allowed for sale and distribution of such products until October 23, 1996. Products stickered under the PR Notice 93-11 options may be sold and distributed after October 23, 1996. Products (other than orphaned or canceled products) stickered under the PR Notice 95-5 option cannot be sold or distributed after October 23, 1996, unless they are relabeled with final printed WPS-complying labeling or the interim WPS-complying labeling described in PR Notice 93-11. RELEASED-FOR-SHIPMENT BY JANUARY 1, 1994 OPTION (PRN 93-11) Products released for shipment before January 1, 1994, could be sold or distributed by the registrant after April 21, 1994, without bearing WPS-complying labeling provided the following conditions were met: 1) the registrant submitted in writing to EPA product-specific information and a statement that the "January 1, 1994 Release-for-Shipment Option" was elected for that product; 2) if, under this option, registrants sold or distributed, after April 21, 1994, a product without WPS-labeling, they were required to notify in writing every person (other than end-users) to whom they sold the non-WPS labeled product of the registrant's offer to relabel or recall any remaining non-WPS-complying product by October 23, 1995; and 3) starting no later than April 21, 1994, such registrants were required to supply appropriate Generic WPS Supplemental Labeling to every person to whom they sold the non-WPS labeled product. All products released for shipment by a registrant under this option after January 1, 1994, were required to bear final printed WPS-complying labeling or the interim (sticker) WPS-complying labeling described in PR Notice 93-11. Products that were released for shipment prior to January 1, 1994, and that do not have WPS-complying (final or interim) labeling by October 23, 1996, are in violation of FIFRA. To achieve compliance, the registrant may relabel product at distribution or retail sites or recall them to a registered establishment. The registrant may designate any person to relabel a product that qualifies for the released for shipment option by using final WPS-complying labeling or the interim WPS-complying labeling described in PR Notice 93-11. The registrant is responsible for any violations resulting from such relabeling. Also, if this product is sold or distributed without WPS-complying labeling, both the registrant and the seller are in violation. PRODUCTS NOT UNDER THE RELEASED- FOR- SHIPMENT OPTION All products sold/distributed by the registrant (except for the "Released-for-Shipment Option" products) after April 21, 1994, had to bear either final WPS-complying labeling or the interim WPS-complying labeling described in PR Notice 93-11. Products not on the "Released-for-Shipment Option" list that were sold or distributed by a registrant prior to April 21, 1994, without WPS-complying labeling may not be sold or distributed by anyone after October 23, 1996, unless they are relabeled by the registrant using final WPS-complying labeling or bear the interim WPS-complying labeling described in PR Notice 93-11. If a registrant fails to relabel non-WPS-complying products, sold or distributed prior to April 21, 1994, it is not a violation by the registrant under FIFRA. Products without WPS-complying labeling in registrant warehouses are in violation. They may be brought into compliance by the registrant using final printed WPS-complying labeling. Product being returned for relabeling must be clearly identified as products which may not be sold until relabeled. IDENTIFYING WPS PRODUCTS WITH PR NOTICE 93-11 STICKERS Products that bear the interim WPS-complying labeling described in PR Notice 93-11 are allowed to be sold or distributed after October 23, 1996. This interim labeling consists of a "STOP" sticker that refers the user to product-specific replacement labeling. The Agency did not require a specific sticker color in PR Notice 93-11 or 95-5, so specific sticker language is crucial for identifying 93-11 products versus products bearing stickers complying with PR Notice 95-5. The sticker language for products relabeled in compliance with PR Notice 93-11 is: "STOP! The label on this pesticide is no longer in effect. Follow replacement labeling received at sale. If you do not have the replacement labeling for this product, contact the seller or registrant or call XXX-XXX-XXXX to obtain it before using this product. The Worker Protection Standard, 40 CFR Part 170, must be followed when this product is used." In addition, the top of the first page of the replacement label must prominently bear the words, "REPLACEMENT LABELING". The registrant is responsible for ensuring that the replacement labeling accompanies the product at the time of sale to any end user. Such replacement labeling should accompany the stickered product at every stage of distribution. PRODUCTS RELABELED UNDER PR NOTICE 95-5 Products (other than orphaned or canceled products) relabeled under PR Notice 95-5 using stickers and supplemental product-specific labeling cannot be sold or distributed after October 23, 1996, unless they are relabeled with final printed WPS-complying labeling. After October 23, 1996, relabeling of such products must be done by the registrant in a registered establishment. ORPHANED OR CANCELED PRODUCTS Orphaned or canceled products are those products which have not been transferred to another registrant and (1) whose registrants are no longer in business, or (2) that have been canceled pursuant to FIFRA Section 4 or 6. As specified in PR Notice 95-5, EPA will continue to allow the sale or distribution of non-WPS complying orphaned or canceled products, provided: (1) the sticker specified in PR Notice 95-5 is affixed to their labeling, and (2) generic supplemental labeling is provided when the product is being offered for sale to the end-user. We intend the posters for use by dealers and distributors to help distinguish which stickered products have a deadline for sale and which don't. The posters have been mailed to dealers who requested stickers and supplemental labeling materials through the WPS labeling hotline. We have also mailed samples to EPA Regional offices, state departments of agriculture (or other state agencies responsible for pesticide enforcement), and state agchem associations. Why did we do this? Our original intent as an industry was to color code the stickers to distinguish easily between those allowed by PR Notice 93-11 (can be sold without time limit) and those allowed by PR Notice 95-5 (cannot be sold after 10/23/96). But color coding was not very successful, and a wide variety of colors, shapes, and sizes of stickers were used. In an effort to reduce the potential confusion in the marketplace, we collected representative stickers, and printed them in full color on the poster, with an explanation of the important differences. This is primarily a concern for dealers, not those who have already bought stickered products (though they should make certain they have the right supplemental label). There should be no need to distribute this poster beyond the dealer/distributor community. We worked with EPA to make certain the message of our poster was accurate. The cover memo sent with the posters explained its purpose, but I can understand how that memo would become separated when the mail is opened. We should have identified the source directly on the poster, and will try to do so if we need to reprint. A previous exception for this industry, granted on June 10, 1994, expired on June 10, 1996. Roses, Inc. has stated that, without such an exception, the cut-rose industry cannot survive economically. This Notice acknowledges receipt of Roses, Inc.'s request and invites comment on the substance of the request.
