This statement addresses labeling revisions required by the Worker Protection Standard for those inscope products offered for sale or distribution after October 23, 1995. The policy statement targets products that are within scope of the WPS, do not bear full WPS labeling, and are being sold or distributed by persons other than registrants. Examples are provided to allow labels to be brought into compliance with WPS requirements, so that such products may be legally sold and distributed after October 23, 1995. This policy was also released as Pesticide Regulation (PR) Notice 95-5 on September 28, 1995. Everything was set to notice the regulation changes. However, In light of the significance of this action, everyone giving approval is looking at it real close. This, together with seasonal time off, translates into more time. My best guess now is that it will go over to the Office of Administrative Law by either January 2 or 9. (Tuesday of each week is their deadline for publishing the Friday of the following week). Publishing in the Notice Register would then be January 12 or 19. The hearings will likely be in March with comment closing around April 1. At this point there doesn't seem to be any new issues, just getting everyone informed and comfortable with the package. The regulation changes to implement the WPS in California have been filed with the Office of Administrative Law. They will be published in the California Notice Register on January 5, 1996. The public comment period will close on March 15, 1996. Hearings are scheduled for Salinas (2/21/96), Sacramento (2/26/96), Visalia (2/28/96), San Diego area (3/6/96), El Centro (3/7/96, and Redding area (3/12/96). A cover letter, together with copies of the Notice, proposed text changes, and the Initial Statement of Reasons will soon be sent to all county agricultural commmissioners. As soon as that happens I will try to send electronic copies to the WPS-Forum for the archives. The Notice and Initial Statement of Reasons usually send OK but the complex underline/strikeout text tends to cause problems. Hard copies of the documents can be sent on request.
