We used to have Spanish tests many years ago, but we dropped them because it does not make much sense to have non-English-speaking people licensed to apply restricted-use chemicals when EPA does not require the pesticide industry to print labels in any language other than English. The WPS covers pesticides used in the product of agricultural plants on farms, forests, nurseries and greenhouses. An agricultural plant is defined as any plant grown or maintained for commercial or research purposes. Is there a legal definition of "commercial purposes"? I ask this question because IGW Q14.34 includes plants produced in-house, but not sold, bartered or included in typical "commercial" transactions as covered by the WPS. Given that, how do gardeners on large, private estates differ from facilities described in Q14.34? And if you go so far as to include private estates, aren't you then including homeowners as well? Without a definition for "commercial purposes" we're finding it difficult to draw the line. In the Response To Comments, the issue only gets murkier. Section II.C.7. of the RTC states: "7. Public areas and residential uses. The Agency proposed to exempt pesticide uses in malls, atria, or office buildings where agricultural plants are present primarily for aesthetic or climatic modifications and in and around habitations or non-commercial crop or ornamental gardens, in non-commercial greenhouses or on lawns, shrubs, or trees..." Obviously, whoever wrote this knew not only what commercial was, but also what non-commercial was. To anyone on the IGW, what did you use as your references for Q14.34? Did this issue of "commercial purposes" come up while drafting the answer? Is this issue open for re-interpretation?
